We have just had windows put in by them but not happy with result so have only paid 1/3. Is it worth paying them any more if their gaurantee is worth nothing. Was told if they do not pass all the checks when fitted we have to pay nothing!!!

i bet they have small print that makes the bit about you not paying worthless.

they will send someone round and they will "pass" all the checks.

but yeh, keep your money as long as you can

Typically when there is a dispute between a home owner and a contractor, the dispute should go to an arbitrator. They can look over the issues of the situation and make a ruling as to who is right or who is wrong.

It's important to note all the problems associated with the services the contractor was supposed to provide. Was the schedule according to their promise, was the quality of work performed as per industry standards, is the product of the quality you expected to pay for, etc.? Consider taking notes and pictures to show the contractor and possibly an arbitrator, to prove your case. Once you have the "evidence" you can write a letter, a fair and honest letter detailing your concerns. Consider giving the contractor an opportunity to correct any problems (the arbitrator will look at this opportunity favorably) and if the projects outcome still doesn't meet you expectations, do the whole process again with the letter and evidence, but this time give them a price you are willing to pay, based on their performance. If you have enough overwhelming evidence in your favor, they will most likely negotiate a price.

Consider also, most contractors are people not unlike you. They have familes and are trying to make an honest living too. Unfortunately we all make mistakes and miscommunications or some other type of problem can and does occur in their line of work, just like yours and mine. I suggest that you fairly look at the situation and if you feel they have been negligent and you or your property has somehow been damaged in some way through their poor work ethics or poor quality, then you have a ligitemate cause for complaint and I am positive they will compromise with you once they realize thier mistake.

It looks bad for a contractor to go to arbitration, unless they win. Also consider if they feel they are right, they can place a lien on your property. You can look up workman's liens, mechanic's lien in your states law pages for how a contractor can place a lien on your property. In this state, the lien goes on your credit, appears on your title report and unless you pay the lien amount (which could be wrong in the case of no compromise) then you will have to pay it at closing whenever you sell your home.

I hope this helps, because we need to protect our property, but we also need to understand contractors are not Gods, they are human just like us and most of them are truly fair and honest.

We had trouble with them about 8 years ago. We had three windows fitted nothing wrong with the actual units it was the workmanship. We wanted a window bigger than the original putting in so work began to make the opening bigger it was so big however that the window was smaller than the opening so they filled it in with a 6" length of plastic, They cut a hole in our lounge ceiling to put in a prop it was weeks before the sent any one to seal it. The man that arrived had no plasterboard to fix the hole and asked us if we had any. The Glass for one window came broken, 2 lots of Pilkington K glass came faulty, & the final K glass was put in the wrong way. There is a right & wrong side for in to work properly. We like you held back some money. We fought for many months, went to trading standards & the CAB they all told us that we had to give them a reasonable time to put it right which we did & they didn't. The man in charge kept changing .In the end we had a company director around to our house. He tried to get us to agree to let them put right & pay them the rest of the money, and in return he would sell us a new kitchen or conservatory cheap. We would have none of this, as we had been unable to use our lounge for months. We stuck to our guns and paid them no more.
You do need to write every thing down though and take as many pictures as you can. There was so much more to this story and it was very trying making our case.
