I GOT DIVORCED LAST YEAR AND I AM PAYING MY WIFE $850.00 A MONTH FOR CHILD SUPPORT. THE ORDER IS JUST FOR MY FIVE YEAR OLD DAUGHTER. I WAS WORKING A LOT OF OVERTIME PLUS I HAD A SECOND JOB AT THE TIME OF THE DIVORCE. A YEAR LATER A LOT HAS CHANGED. I AM NO LONGER WORKING A SECOND JOB AND OVERTIME IS NOT AVAILABLE LIKE IT USE TO BE. MY EX-WIFE ALSO HAS REMARRIED AND HER NEW HUSBAND GETS PAID WELL. THE $850.00 IS KILLING ME FINANCIALLY. HOW CAN I GET THIS CHILD SUPPORT ORDER CHANGED. SOMEONE TOLD ME I HAD TO WAIT THREE YEARS AFTER THE ORDER WAS MADE. MY SALARY AS OF RIGHT NOW IS $45,000 A YEAR AND MY EX-WIFE IS AROUND $30,000. PLEASE HELP ME.

You need to petition the courts with a petition to modify the support order. You have had a change in circumstance and you prove-up your case with proof of paycheck stubs, and W-2 's for taxes.

You also need to have the judge look into the fact your wife is employed too......Her wages should also be calculated into the equation of child support.

If you only have 1 child.. You are responsible for 27% of your gross income.....after Federal Taxes, State Taxes, Medicare ect has been deducted from your check..... Technically you should only be paying about 450.00 a month for child support on a NET income of $45,000.00.

Seek out the courts and get your petition modified!!! If you don't...your X will be sticking it to you forever!

I've provided a child support calculator------remember this is NET MONTHLY...not a yearly calculator....

Plug in the #'s if you have the child weekends...figure it at 30% for visitation.....you'll get a calculation of child support....and this is very accurate #'s to work with...

Your ex-wife's new husband's income has nothing to do with your child support. He is not responsible for your child in any way.

You need to contact a lawyer as soon as possible and have documented proof of your present income. I'm sure the courts will lower the amount you have to pay.

Even more important, I hope you are taking full advantage of your visitation rights so that your child will always feel loved by you.

You will have to go back to court. Show the judge all the proof, that ur income has changed. Im sure that the judge will change the support to one that is a lower amount.

definetly go back to court. go there right now with some recent pay stubs, they'll put a temporary deal in motion right away. she'll be served papers, and a court date, the judge will look it over and take your new income, and adjust it accordingly. with your income,a nd one child you should be paying around $200 a week...dont let her take advantage,it doesnt mean you dont want to pay for your child, it just means that you need to live also. good luck!!

ok, they take 15% of your pay. go and change it and have proof that you cant afford it all, they can lower it. prove that you dont have a second job and that you dont have overtime. it can and will be done. dont worry.
