it seems false when put this way

what if the people want to outlaw murder?

so it seems the people have a right, indeed a duty, in their pursuit of happiness, to outlaw things they think are bad

but what if the people decide that unlimited fortunes are bad [as they should have done 1000s of years ago, imo, as unlimited fortunes kill 1000s of times more than murder does]

ppl argue that if the people want to outlaw unlimited fortunes, it is wrong, it is invasion of liberty

but what if the people decide [realise, as the founding fathers did, and as every wise person did] that unlimited fortunes are theft, tyranny, the death of democracy, justice, order, law, freedom, peace, happiness, the state [and now, thanks to e=mc2, all humans and all life]

what if the people realise that 'the state built on injustice cannot stand' [roman], that 'equality breeds no strife' [athenian], 'power corrupts' [or: the corrupt seek wealth-power more ardently], the powerful break the law?

popular opinion doesn't necessarily reflect the views of the people. Consider Prohibition,a good idea but an unpopular thing in application.The law did more harm than good just like the existing drug laws. The only thing that the 'war' on drugs did was make them more profitable to the importers and dealers. If the powers that be were to legalize marijuana,tax and regulate it just like alcohol all states tax revenue would rise,people using harder drugs would dwindle.Prison population would fall off.And the world would be a mellower place.

Show me where the Founding Fathers were against capitalism, because I have found no evidence of that statement. There is no crime in amassing wealth unless it is obtained by illegal means. People cannot amass wealth legally without providing a product or service. In turn this product or service must be in demand. While I will agree that power does corrupt and money is the root of all evil, your post is not about democracy or capitalism. Rather it is an attempt at veiled socialism. Additionally please provide evidence of those with large fortunes killing people in mass. Corporations may benefit from wars, but it is governments which create the hostilities. If you want to argue that the government is being high jacked by people with money and agendas I will agree, but capitalism is the cornerstone of our system and whether you choose to believe it or not, it is why we are currently the world's lone superpower. Even nations like China have learned the value of personal achievement and wealth, but alas some people will always blame the rich for all the failings in society. Rather than the true cause which is lack of ambition on the part of people. In this country you are only limited by your own personal failings. There is no grand conspiracy designed to keep you down.

Russia decided that all people should be equally paid and have equal possessions. Do you know why it failed? Because it took away incentive and motivation. Why should a farmer work 10 times harder than an office worker and get the same pay? Why should a person work in hazardous waste and get paid the same as a garbage collector? Why would someone dedicate 7 years of their life to schooling to get minimum wage? Why can’t one work as hard as they can and become rich if that is what they want? Why should an ambitious person carry the load for the lazy person? Competition breeds excellence. I want to live in a world with color, not in some blah, gray washed world where everyone just drones on. If that’s the way you want to live, then you can still move to China or Cuba.

"Wrong" is a question of conscience. Some things are lawful but in my conscience I would consider it wrong for me to do them (such as binge drinking). Some things are unlawful that I would personally find acceptable for those who want to do them to be allowed to (for example, sex between a 15 year old and a 16 year old, both consenting).
