You don't and you can't unless this person is missing or dead, or moved to another Country, but even if that was the case, it still takes a long while for the judge to sign the petition, it might take up to a year or longer. If your marriage lasted less than 3 months you can get a dissolution of marriage through an annulment, depending on the reason or circumstances, the judge decides.

I know for a fact that you do not have to sign any papers to get a divorce, or show up in court either. If you are looking to the court to be fair without you showing up forget it. The Judge feels like if you do not care about yourself enough to show up then whoever is there will be the one to be awarded what ever they ask for. That happened to a friend of mine He was forced to sell his home and pay all the bills she created while they were separated. Even a set of living room furniture and a set of tires for her mother. The reason he did not sign or show up in court was because he loved her and did not want to be separated from his children. After eleven years of marriage and two children and a religion that did not allow divorce. She convinced the church elders that she never loved him in the first place so they granted her an annulment of their marriage. that left him without a home, his kids and a religion that he no longer believed in.

You have to prove that either the original marriage was not valid, or that by continuing with your marriage you are being placed in a position of realistic risk. This needs to be taken to a court, or an ADR conference to attempt to convience the other party to sign the paper. Otherwise, without a direct order by the judge to dismiss the marriage, I don't think there are other ways.In addition, not all country supports such judicial enforced dissolution of a marriage. There are two ways. One you prove that while staying with the other person you are seriously mentally harassed and that the character and integrity of the other partner dubious and or your life is at risk while staying with him.
Second you prove your marriage as illegal which to my mind is very difficult thing these days. Also consult a good lawyer.

Go to your local courthouse, or circuit clerks office, and ask. My brother is getting a no fault divorce. If your spouse abandons you, and you do not know where they live, and they do not respond to the ad you have to place in the paper, then you can divorce them without their signature.

As long as alimony and/or child support is not required the signature is not needed. Also if the other does not resist and decides to do nothing.

if that person is served with the papers and does nothing, you can get a default judgment.
The law recognizes consent by silence.
