My unborn baby's father has a drug and drinking problem. I am wondering at the time of birth or soon after can we insist that he has a drug screen and if it comes up positive can we insist that he completes a drug rehab class before he is allowed to have the baby?

You need a lawyer. It's possible to restrict his time with the baby, or to require supervised visits, etc., but you can't do this on your own. Get a lawyer now, before your baby is born, so you can document his addiction history. This will let you be prepared if he tries to get visitation with your child.

If you are not married to your baby's father, he can't see your baby without your permission. It will be up to you to decide when he sees your baby (or not.) Unless the baby's father has a record of drug use, it would be very difficult to get a judge to make him go into a treatment program of any kind. I would suggest that you ask him to go into a rehab facility before the baby is born. If he refuses, don't let him be around your baby. I hope this helps.

Involuntary attendance in such courses has a very low success rate. If you were my daughter, I would talk to a lawyer about getting him declared an unfit parent.
Then, you can work with him to get him cleaned up.

Don't be to quick to let him off the hook to help financially. You can expect that help even without visitation rights in most states.

Nope dont think so.Unfortunately I dont think you can make him do that. Only a judge can do that and you would need something to back up your claims such as an arrest or something for drugs. My suggestion is to breast feed as the court takes that into consideration when dealing with visitation.

talk first to your doctor, and then to a lawyer. anything you do needs to be legalized. Make sure your baby is healthy, and not effected by the drugs that the father is on!

It may me able to be enforced, You would have to turn him into the authorities and file paperwork with the Family court of your jurisdicition. They may honor it if he is found to be guilty and order treatment. If the court hears your case and agrees he won't have a choice

Since he is the father he has the right to see his child. If you deny him that right, and he takes you to court, then you tell the judge he's an unfit parent, and recommend treatement.

yes, go to courts, get the paper work, you can wave the fee if you need to. explain to them what you are looking to do.
If its in the best interest of your baby, I'm sue something can be done.
