U had to stop on freeway-a van had stopped in road in front of you.
While stopped, waiting to get around, someone rearends u???? The police are called--yet write no ticket---this car you r in is a 24,000 dollar car to be paid on for next 5 years. It has minor damage but u wonder about the resale vaLUE. What is the best method to deal with this? Back is hurting? Wife is having headaches? What would u do?

I am not asking for sympathy-just what u would do in this situation. Car is to be paid on for 5 more years!!!

I just have to commend the last answerer for noting that "your wife" can take some tylenol. In which state did they legalize same sex marriage again?

It's a good question. Since both cars were moving forward, they may have hit pretty hard and only incidentally left no dents, so a mechanic's inspection could be given to the frame.

PS -- To the last guy: she's a smart chick. She takes lots of tylenol.

If your back is hurting bad enough that you want them to pay for it, then you should be willing to pay for it. If you are in extreme pain, then go to the Emergency Room. If you are not, call your doctor when their office is open and make an appointment. Same for your wife. Something to keep in mind - often after an accident your whole entire body will ache. Depending on how long it has been since the accident, I would consider your wife's headache somewhat normal due to the stress. Has she tried taking Aleve, Tylenol, etc?

If you get the car fixed, it is not going to affect the resale value hardly any. If you don't get it fixed, then it would affect the resale value according to the amount of damage (and if any rust has occurred as a result of the chipped paint, etc.) Usually, people trade their old car in when they buy a new one, and it's not like the dealership runs a CarFax on it. They just look at Kelley Blue Book.

Don't know what state you are in, but in Indiana, the police only write a report if the damage is significant.

Basically, this is common sense stuff. I think you are wanting someone to help you rationalize suing them though. It sounds like a fender bender, and does not likely warrant a lawsuit. And really, you ought to wait until you have filed a claim against their insurance anyway. Most likely they will take care of fixing your car & any medical bills.

In California the person that rear ends someone is always at fault. You have a police report and you have insurance, but your wife's back as well as yours is hurting. Wait no more and get medical advice or help to ease the pain, next go to an attorney. Like someone already said they don't get paid unless you get paid. Let the injury attorney sue the other insurer and get your car in for a check up of the undercarriage and bumper as they might have sustained unseen damage and only they can find it. Any damages should be covered by the other parties insurance as well as your medical bills. Anything above and beyond that is called pain and suffering for witch you are entitled to compensation. It is here where the attorney makes his money, the more he gets you, the more he makes and that is up to 30% so shop around anything more than that and you won't get any money for you only for them...Good luck

Minor damage yet you have back pains and a headache...been talking to a chriopracter already haven't you? Minor damage will do NOTHING to hurt resale value on your piece of crap Prius in five years. You lost 10% of it's value the second you signed the paperwork -- how does THAT effect resale?
Your problem is you are just mad and want to cash-in because some poor slob smacked you while standing still on the freeway (or did he single you out and ram you on purpose?)
Just let his/her insurance fix the damn thing and get on with your shallow life. Better yet, get a lawyer...PLEASE hire a lawyer! He will take 40% of your settlement after he drags it out for eight weeks....because he is working for YOU! (right).

report it to your insurance accident, 95% of rear end accidents aren't your fault. See a doctor, if things are bad, get a injury attorney to work on a contingent basis.

Bring your car to a quality autoshop and have them take a good look. If it hit hard enough to give her injuries, it may be more than cosmetic.

Fight for your rights, you pay those SOB thousands a year, make them work for you

Hopefully you got his insurance information. Report this to your insurance company and let them work it out with his insurance company. Generally, when someone strikes you from the rear, they are considered responsible for the accident, even if no ticket is written. You should be covered for your medical expenses as well.

find a good attorney and sue the person who hit you . most attorneys will take cases on contingency, they don't get paid unless they win case..hopefully you have witnessess..
