I work as a waiter in a restaurant and this guy came in pissed off at one of his customers and I could have sworn I saw him scratch the cold sore on his lip and wipe in on the persons burger. I saw him duck his head away and scratch in the area where he has a big cold sore. I didnt get a perfect look but I definate saw him rubbing the rim of a persons hamburger bun. The kid is also the managers son so I dont want to make an accusation. I am not even 100% sure if he did. What should I do?

I don't care if he's the son of the manager, or not. Maybe the Dad should be informed, it's his job, and responsibilty to run a clean establishment, and if he doesn't do something, call the board of health. They'll both be warned. I'm glad I eat at home ~~~

If the waiter's father is the manager, I would go to him privately, explain to him that it is very hard for you to tell him this, but tell him everything that you saw. Tell him that you thought it would have been easier to tell the health department than him, because this creep is his son, but that would not have been fair without the manager knowing, but you waived the fact that his son was his son.
I think he would appreciate this. If someone ever found a cold sore scab or saw something funny, or got sick, they may link it back to the restaurant. You also have to take the customers into strong consideration. They do not deserve that poor service. What if this waiter had hepatitis or some other disease transmitted thru body fluids. Do it for the customers. It is the right thing to do. You can always find another job, and explain WHY you lost your job. They would look at with you with the utmost respect and deep integrity, and hire you on the spot. Thanks for caring about something like this. In a way, you are a little part of a hero...Also, if he tried to fire you, you could fight back with wrongful termination.

This is why you never get a food server angry at you until AFTER you have gotten your food. I have heard of boogers, spit, urine, and visine being put into customers food. The visine supposedly gives a person the runs. I worked for a long time as a server and manager and this happens all the time.
Customer has a bad day, and comes in and and takes it out on the poor server. People treat you like you are doormat and walk all over you. The server gets some cheap revenge and some self-respect back.
I'm not condoning the action, but it is understandable.
My advice is ignore the incident. No one likes an informer and if it doesn't directly affect you, just let it go. Who do you think his Dad or Mom is going to believe anyway ?
Oh yeah, don't have this guy serve you, either

I read in Phoenix newspaper a few years ago about an ex-con hawking up a loogie and spitting it on a cop's hamburger. Cop bit into the ball and arrested the cook. Don't know what he was charged with, maybe endangering public health. If I worked with the guy you mentioned, I'd get another job or turn him in to the health board. He should not be working w/cold sore around food.

OMG... you have to report him but the creep is the mangers son... so might have to kiss your job good bye... I'm sure you could report him the same time you give your boss your two weeks notice... tell your boss you refuse to work amongst anyone that would risk another person health... and I guarantee you'll feel good afterwards knowing that you did the right thing... by protecting the customers health... if you have only seen him once... I bet he has done it before and it could have been something you ordered....

Just because he's the manager's son, doesn't make me intimidated at all. Tell his parents. It's better to be safe than sorry. What if you were the one who ate that order?

Accidentally knock the food onto he floor. Wait for it to happen again, then knock him on the floor. Do not date this boy. He is creepy. Do not eat in fast food establishments because he is not the only gross freak that does this.
