I bought an item on ebay from someone with good feedback. It arrived and the size was smaller than listed in description. Seller agreed to give me a refund and I returned item to her. 3 months later I still have no money. I paid with money order (my mistake) and I have sent many emails to which she always responds with a promise to pay me as she is "honest and not trying to steal". ebay can't do anything to make her pay. They suggested I try Square Trade and the Internet Crime Center.
Does anyone have any advice? She lives in Illinois and I live in Texas.

Square Trade usually ends up costing you $50 to get results.

Although the Internet Crime Center is a great site with lots of scam information, don't expect much action unless it's a high priced item, or the person in question is in their database as a multiple offender.

The Mail Fraud angle works and is good advice.

As far as feedback goes, that's a personal choice.

Since you MAILED the payment to her, you can file a mail fraud complaint with the post office. It doesn't matter where in the USA she lives if you mailed the payment to her. She accepted payment through the United States Postal Service, and if she doesn't pay you back she will be soooo screwed it isn't even funny.

I had this happen to me once a few years ago. I got jerked around for months by one seller until I filed a mail fraud complaint at the post office. I could not believe how seriously they (the USPS) took the matter after being given the runaround by Ebay, etc.

File a mail fraud complaint and you will get your money back. Send this form in: http://www.usps.com/forms/_pdf/ps8165.pdf#search=%22mail%20fraud%20complaint%22
along with a copy of the cashed money order and a print-out of the Ebay auction, your return receipt for the merchandise and all the e-mails. Believe me, she will either refund your money or get arrested.

Not much you can do except leave negative feedback to the slug. Of course, she'll probably leave retaliatory feedback on you too. It's one of the weaknesses of buying stuff on eBay.

Give it up and chalk it up to a learning experience. Is it really worth the hassle?
