A friend of mine owns a small business located in a skyrise. He was not available to personally fire the employee but he reported her to security and told security that the employee was no longer allowed in his office and to collect the keys from the employee. When the employee showed up, the person was unable to go up but did not relinquish the keys stating the he would not do so until he received the pay check. Do we have the right to deduct the fee for lock and key replacement from his paycheck?

The answer is no. You can hold the paycheck until the keys are relinquished but you can't automatically assume that he's going to keep the keys. Hopefully they are keys which can not be made without special authorization...and they should say "do not duplicate" on them. If all the former employee is asking for is his check prior to turning over the keys...then give him the paycheck and get the keys...that simple.

i think the employee was not accorded due process here. even if an employer thinks the employee deserves to be terminated, there must have been due process, that is, she must have been informed why she would be terminated and when. good for your friend if the employee would not file a case about this.

to answer your question, no, you do not have the right to deduct any from her paycheck. any deduction from employee's paychecks should have the authorization of the employee concerned.

the best way to approach this is to talk directly to the employee and explain to her the situation. but she still has the right to file a case or seek redress for her situation.

Nope.

And your friends reasoning is faulty. The employee could have handed that one key over and still have had a bag full of duplicates in their car.

If a lock needs to be changed for security reasons, fine. But don't try and palm off the cost to other people.

i might say confident. in case you had by possibility overpaid them for the rest then you are entitled to the money decrease back. whether this is a real errors then you ought to have the skill to deduct the money from a destiny paycheck. If the worker will not be getting paychecks from you, you ought to probably circulate to courtroom to get the money decrease back yet you will possibly in all possibility spend extra to get it than what this is properly worth. this is similiar to if a financial business enterprise had made a mistake and placed money into your account that ought to not be there. I even have customary a pair of human beings who have been given into complication using fact this passed off to them and that they spent the money and tried to argue that it replaced into the financial business enterprise's fault and that they weren't vulnerable to return the money. The found out that even however the financial business enterprise goofed in putting the money there, it replaced into not their money. ultimately, think of roughly this. Is getting this money decrease back properly worth dropping the worker? there is often the possibility that the worker will stop because of this. some workers are helpful sufficient to forget cases like this. in spite of the fact that, pay attention. in case you bend the guidelines as quickly as, it is going to set a precedent and any worker can assume you to do a similar for them.
