While arguing with my wife she pushed me across the room. I got pushed up against the sink and picked up a frying pan and raised it and told her to beat it. I am charged with assault and possession of a weapon.

not. you should have pressed charges on her. you were merely defending yourself. next time crack her one.

based on all you speak here. not guilty.

with all due respects to professional input there remains the discovery of other relationship facts/facets among the two of you.

i want to add that there have been special interest resourceful which have created an imbalance of responsibilities and realizations to relationship which makes most assault and batteries male responsible ... unless an offending woman makes blatant the offence.

the creation of domestic assault laws were created to protect women and children in the main and most certainly can be considered bona fide. however......the current status of domestic assault legislations neglect a wide range of human relationship probabilities (possibilities). and this is because it would include the necessity of society being responsible for its' own cause and creation to domestic (or any) assault.

and since this is the case there are actual offences which were not.....are not and likely will not ever be legislated for the protection of any family member.

in short....there are a wide variety of mental/emotional assaults not considered (because they are not considered whatsoever) criminal and therefore rendering female or male and child quite vulnerable.

these laws which were created will only be helpful for a fraction of the assaults which occur and will absolutely actually create more harm than good.

I don't know if you are telling the whole story here. Who started the shoving first ? Who made the first threatning move ? Did you hit your wife before hand with your fist, or slap her ? Did you hit her with the pan. Are you leaving out anything that would implicate you? From the story you tell here .. on the surface sounds like domestic violence between the both of you. Well it sounds as if you were going to use the frying pan if you had to. That's a weapon. You could have brought charges on her, she assaulted you.

Yes, you are. The only way to justify hitting or pushing her in anyway is self defense. But you would have had to leave the situating immediately. and call the police yourself. Depending on which state you live in, the laws are different. My suggestion would be to get into anger management before I went to court. It has been my experience that once this type of thing starts happening, it unusually continues if no counseling is present. And if your wife is not willing to make the changes, that BOTH of you need to, try to leave before the hatred is irreversible.

In law, assault is a threat to hit or injure a person. (Battery is the actual unconsented touching, hitting or injuring.) So yes, you are guilty of domestic assault.

You are a battered spouse and can file your own complaint.

I doesn't sound like you did anything wrong.
BUT...if you intend on maintaining a residence with her, she needs to be told (in plain, kindergarten terms) that you will not tolerate her putting her hands on you!
So...the next time you get into a heated argument with her, let her know that she might want to go outside and calm down by smoking a cigarette or cutting the grass...'cause if she puts her hands on you, there will be negative consequences.

The 'boys don't hit girls' thing died a long time ago. Of course boys and girls hit each other. There's nothing better than a good old-fashioned brawl with your sex partner. It's chic.
