Under section 139A(3) of the Income-tax Act, 1961, any person who is otherwise not required to have a PAN can apply to the Assessing Officer for PAN and AO will allot him a PAN and issue a PAN card

Yes you can have and I would suggest that you have as sometimes some banks or some organizations insist on 3 years of IT return for few things and you can always file a return with 0 income.

So you go ahead and get a PAN card and start filing your return even with no taxable income.

PAN card is simply a number that identifies the person. You can get yourself identified without any limitation.

But remember to do it only once and not more than once

even if you dont have a taxable income you can have PAN card
