I went to PR on a vacation and had a one night stand and became pregnant, I would like to know if he can come over to the US and take him?

Puerto Ricans are citizens of the United States, so in essence it would be the same as someone gaining out of state custody. They could file for a hearing and then based on income, lifestyle and living situation the judge will decide where it is best for the child to go. The judge will order paternity testing if you did not include him on the birth certificate for sure. As a birth parent he will have the same rights you do and can order visitation for himself and his parents even. Neither one of you control that. Judge decides whatever is best.

I would suggest hiring a lawyer that specializes in this type of family law.

First you should know that a "citizen from Puerto Rico" is an American citizen the day he's born. So in that sense, he's just like someone from any other part of the U.S.

No matter where you live in the U.S., the courts are not going to give him full custody of the child simply because he's the biological father. Furthermore, I CAN guarantee that Puerto Rico is NOT going to help him in that endeavor.

Of course he can sue for custody, but it's going to be a hard one to win unless you are deemed an unsuitable mom - especially if the Puerto Ricans authorities are brought into the case. In any case, make sure you get some legal help but stay cool.

He'd have to file a paternity petition first. Once he proves paternity he can file for custody. He'd have to prove you to be unfit and that he can provide a better home for your son. You'd be wise to contact an attorney sooner, rather than later. Don't react to any actions the father might take. Be proactive. Be armed with information. Be prepared. So if you are served with a paternity petition you won't freak out. You'll know what to expect. Be the best mother to your son that you can be. Don't give "the system" any reason to think that you are unfit. God bless!

Take him, no but have visitation rights, yes. And rightfully so. Every child needs their Dad just as much as they need their mom in their life. I hope you make the right choice for your child's sake.

P.S. Provided the Dad is a fit dad, I stand by my answer.
