The guy who says that it is free is wrong. If you sign up for an account you get 1 month for free. That's it.
If you have an account, the 360 will take you through a recovery process to get it on the 360. Once it's there, you're set.
To better answer your questions: Xbox Live is universal; you can use it on either Xbox or 360. I have both and can even log on at the same time with both systems.

i think you can, but the good thing is that the xbox 360 has free xbox live

yeah you just have to transfer the information from your old xbox to the 360.

throw your x box 360 away and buy a playstation 2 or a playstation 3
