Absolutely, legalize it.
There was no legitimate reason to have it illegal in the first place.
The legislation to ban it was pushed through congress by use of racism against mexican and black jazz musicians by lobbyists from the paper pulp (from trees) and cotton industries. If you read the congressional hearings on banning marijuana (Harrison tax act) it is littered with phrases such as "marijuana makes blacks think that they are as good as us and it makes them look at our women".
Furthermore, federal government at the time did not have the constitutional authority to ban a substance. That authority was in the individual states hands. But the federal government did have the authority to levy a tax on it and not provide any way to pay that tax. So if you were caught growing or selling it you were in violation of tax evasion. This is one of the first documented instances of congress doing and end run around the constitution.
Just a few years before it was "illegalized", congress mandated all farmers grow it, to support paper and clothing manufacturing. All of the uniforms for both the union and confederate armies were made from this extremely durable material.
It was not called marijuana (the Spanish word for hemp) until the manufacturing competition was pushing the legislation in congress to ban it. Thus the people in congress did not really know what it was that they were banning. It was and always will be the same plant, although through selective breeding we have increased the delta-9-tetrahydrocanebinal content in the plant just like the tobacco companies did to increase the content of nicotine.
Here are some things to keep in mind:
5 acres of hemp that grows back every year creates the same amount of paper pulp as 1 acre of trees that take decades to grow.
The fiber from hemp is twice as strong as that which can be obtained from cotton and makes the most durrable natural cloth or rope.
The seeds can be for lubricants and fuel oil.
Farmers worldwide have harvested the crop for the past 12,000 years for fiber and food, and Popular Mechanics once boasted that over 25,000 environmentally friendly products could be derived from hemp.
Marijuana is far less dangerous than alcohol or tobacco. It fails to inflict the types of serious health consequences these two legal drugs cause. Around 50,000 people die each year from alcohol poisoning. Similarly, more than 400,000 deaths each year are attributed to tobacco smoking. By comparison, marijuana is nontoxic and cannot cause death by overdose. According to the prestigious European medical journal, The Lancet, "The smoking of cannabis, even long-term, is not harmful to health. It would be reasonable to judge cannabis as less of a threat than alcohol or tobacco."
Hemp is legally recognized as a commercial crop by the United Nations Single Convention on Narcotic Drugs, the North American Free Trade Agreement (NAFTA), and the General Agreement on Tariffs and Trade (GATT).
