If a couple of illegal worked at a restaurant. The restaurant wanted them to get legalized. And they waited and missed the deadline? So the restaurant has no choice but to fire them. How does these people have a right to sue?

Sue on what grounds? If they are required to have green cards so they can legally work, and they don't acquire them, the business has the right to release them.

Is this an actual case?

A law is a boundary that society establishes. It says, "Stay within this boundary and you are safe. Go outside this boundary and you will be punished." I do not understand an illegal having the right to sue over being fired for not complying with the law. Seems kind of stupid for them to expose themselves to deportation. If they get deported, then they will never be able to apply for citizenship. The US (I assume you are an American) has gotten very tough on people staying in this country with expired visas. In almost all cases they are deported and permanently banned from reentry.

Ok, I do believe that they don't have the right to sue; but the problem is that they will get the right to sue...being able to work in this country gives them the right period. Now most of you know how I feel about this issue...but this is the problem with compaines that hire illegals to begin with. If they never would of hired them, then we wouldn't have to worry about paying for this in court...cause believe it or not we will end up paying for it.

I don't think they would want to sue, because then they would be exposed as illegals, and would probably be deported. it is unfortunate that their are people who would take advantage of someone who cannot turn to the law for help. It is just one more reason to make sure you are here legally so unscrupulous people cannot take advantage of you.

They should have gotten green cards. The restaurant is in the right legally. So, they will lose if they sue.

Why should they have any right to sue. They were the ones breaking the law. You don't sue employers for following the laws!

Very good question!

There is
COMMON LAW
CONSTITUTIONAL LAW
COLOR OF LAW
UNIFORM COMMERCIAL CODE
MARSHALL LAW
LAW OF THE WATER aka MARITIME OR ADMIRALTY

Your question has so many facets, I highly recommend you obtain a BLACKS LAW DICTIONARY. Check the net for a store near you to obtain one.

PS: THERE IS NO FREEDOM UNTILL YOU UNDERSTAND WHICH LAWS CONTROL YOU

They are illegal. NO! They do not have that right. In fact, let them file, then they will be deported.
