if there were houses next to you and you owned the property and the land then yes you would own it

As far as I am aware, if the property is Freehold, you would have... ("Oil strike in Orpington" has a strange appeal about it!)... the ownership of the well.. That said, the Council could attempt a compulsory purchase order.. Health & Safety would have a field day (excuse the pun) and any neighbours would probably lynch mob you.

An equally interesting question would be. Whilst digging your potato patch, you come across the lost crown of Ethelred The Unready....now, that would be interesting.

It depends on the law where you live and the deed rights.

Sometimes you own your land but not the mineral rights.

This all of course assumes that it's legal where you live to even extract the oil from your land.

Generally all mineral rights on land (This is in England) belong to the owner of the land. Unless you have a lease on the land that specifically gives you rights to minerals it would not belong to you.

If you own the land then you own the oil - however make sure it isn't just a leaking underground oil pipe, if this is the source it isn't yours.

if it was an oil well it would be mine.
if it was a leak from the councils vehicle depot they can take ownership.
