If the parental rights of the other parent have been terminated by law, the courts usually only give about a 1 year period for that parent to appeal. If she/he failed to appeal by now, I doubt if the courts would allow her to come into their lives and cause disruption, especially is she hasn't seen them for 4 years.

You most likely won't be able to adopt the boys until you and your fiance have been married for over 1 year. This will show the court that you have an established marriage and that you have all had time to ensure that this is the best decision.

I assume you are talking about the termination of parental rights. There isn't enough information here to know. What was the circumstances of the termination? Is your fiance a man or woman? Where are you located? Laws vary by country and locale.

You can petition the court to adopt and if the other party does not object then you will be granted the petition. If the person has not appealed in four years it is doubtful they would do so now. If you and your fiancee know the location of this person then contact them and perhaps they will agree to petition the court with you. If all parties are in agreement then the judge will probably grant the adoption.

the answer to your question is tricky. No he cant appeal but he might be able to readopt the kids but i don't think the court would allow him to since he terminated his rights. but if the kids were adopted by someone like the grandparents so that he could terminate his right then they would have to approve of the adoption. i hope this helps.

if you didnt lose parental rights to your fiances boys, than yes you can adopt them, but do not try to adopt the child/children that you gave up the rights to..

IN MY EXPERIENCE ONCE THE TERMINATION HAPPENED THE BIRTH PARENT COULD NOT HAVE IT CHANGED. THE BOYS ARE FREE FOR ADOPTION, IF DSS IS INVOLVED THEY WILL HELP YOU ADOPT THE BOYS.
