Does you'r Local City Council, pick up your trash? Isn't the garbage company, then go after the right people.

Yes you could threaten, and you could take legal action. However you would have to prove that you had followed all the procedures set down by your Local Council for the collection of rubbish (i.e. putting the bags out on the correct day in the correct place; putting the correct rubbish in the correct bags; not leaving more than the maximum amount of bags out for collection).

A more constructive way forward would be to contact your local Councillor asking them for assistance in getting your rubbish collected. If this fails then contact your Member of Parliament.

Finally, rather than threaten legal action, which is costly and potentially unsuccessful, tell your Local Council that if your rubbish is not collected you will be contacting your local newspaper/radio station. A photograph of un-collected rubbish is not a Local Council's idea of a good day!

Of course you can THREATEN! That is easy - just say "I might take legal action against you".

But the council are happy enough to take your council tax - which is in effect payment for services they provide - so if they are not providing the service, they are taking your money under false pretences.

Write to them. Ask them WHY they are not collecting your rubbish - perhaps it is not deemed household rubbish - if it is a case of MISSED collections, tell them that you will be withholding a certain amount of your council tax payment for each collection that is missed. Make sure you keep this money to one side so that you can pay them when the situation is rectified.

Chances are, they will threaten to take you to court for non payment - make sure you keep ALL receipts and copies of letters - then you can prove that you have been making payments, just not FULL ones because they are not providing a FULL service. I cannot answer for what the magistrates (or whoever) would say - but surely a reasonable person would deem the council to UNREASONABLE.

Oh yeah! That way, they instigate any legal action and if you win, they PAY too!!!!

no you cannot threaten them,but you can advise them that you are looking into getting legal advice.call the city you live in ask to speak to the person in charge of trash pick up and then call the garbage company who usually picks up the trash they should have a contract with the city and complain to both. if this doesn;t work, then contact your local state representative. that is what i had to do when it took over 5 wks for them to pick ours up. lucky for us our state rep. lives in our home town and has his own insurance comp. also you can try contacting your local news /media and report the problem and contact your senators and the Mayor of your town. but do not threaten then they can get you for harassment ...if you have to, just keep calling everyday and just ask are you coming today..

you can try but they won't listen. Apparanty the bin men have more authority than yourself i found these days. My borough has chosen to ignore my many pleads to collect my rubbish- now no one will come to visit me anymore becuase i have crap decomposing in my front garden since summer! What a joke this whole new recycling system has become.

Make your home a compost heap manufacturer! Thanks you moron councils!

You can THREATEN anybody with legal action for anything at anytime; however, whether or not it will make any DIFFERENCE is a separate issue entirely.

Get as Many of your Neighbours to support you as posssible= "Strength in Numbers" and collectively refuse to Pay for what you are entitled to but not receiving . - the results will be swift.

i don't think it would be wise to "threaten", you can probably take your dispute to the next level if no one is helping you with your trash pick up. or you could take it to your local dump and have them pay the gas and dumping charges. (make sure you have the reciept or ask for one.)

It depends on when you actually put it out was before collection or after that only you know it happens here too only I know that it gets put out after they have been once already

They will only nod their heads and say they understand and probably do nothing. Do you pay for rubbish pickup? Don't pay them and see what happens.
