Story is my sister has been dating an african american guy for a little over a year now. He is 34 she is 22. He has no job or money and basically lives off of my sister. Last month i get a call from my sister crying and it turns out her bf hit her, So i say im coming to see her, 300 miles away, she says no shes going to come to my place the next day.

Well the next day she shows up but with her bf. I wouldnt let him in my place and wouldnt let my sister leave with him. He started getting in my face and telling me I was racist and that i needed to get over the fact that he was doing my sister. Well this was all pretty loud so by now we had a audience, all the neighbors in apt had come out to see. I tried to go in to my apt and close the door but he blocked it with his foot all the while yelling at me that i was racist. And I lost it so i stepped out and dropped him followed by lots of punches with regrettably some racial slurs. Im getting charged with a hate crime.

Im not worried about outcome just more along the lines if people think stuff like that constitutes a hate crime...i did get a lawyer and its a trumped up charge cause i beat him up fretty good. The racist slurs werent what you think either...basically they were "how does your black *** like that you piece of shi#" as i was punching him. I live in a small big city which thinks they need to take those types of claims way seriously so they go over the top initially

Im happy though my sister is done with that relationship.

Well, what you should have done is simply called the police on him. If you punched him first, even if he was invading your privacy, and on top of that you called him names / racial slurs, then yes, you probably will be.

Any good lawyer however will be able to get you off these charges if you had witnesses to the situation and they will say they saw him trying to force his way into your house.

If you are being charged with a hate crime, you need to get an attorney. Clearly, your actions did not stem from him being African American, but from the fact that he hit your sister, and then refused to leave when you told him to leave. Was he also arrested for trespassing? I believe that's the charge when someone puts their foot in your door and does not allow you to close it.

I am sure if the argument before the beat down was as bad as you say, there are plenty of people who know what happened. He seems to have been the one to first introduce racism as an issue. When you get an attorney, give him or her the names of your neighbors so they can confirm your version of events.

I am not sure which state you live in, but where I live, hate or the desire to violate someone's rights has to be the primary factor for a crime to be considered a hate crime. If you showed up on their doorstep with a baseball bat because he is black, that would be termed a hate crime. But a crime that is committed for another reason, even if it includes racial slurs, is evaluated differently. Be sure that everyone involved, including the police, understand that this was not a matter of racism, but rather a matter of defending your sister. And get someone who can corroborate your claims that he was the one who started in on the race thing first.

I think that's the easy way out for them,pulling that god da*m race card.The dudes 34,unemployed an abusing your sister.I'm sure the color of his skin was the least of your worries.And I'm sure as soon as the cops came he told them about the racial slurs.I can recall quite a few times I've been called honky or white trash,but if I would of called tmen the''n word''They'd be on their phones to the cops and boom,I get charged with a hate crime.Find some non-whites at your apt to be character witnesses.That's your best bet,they don't joke around about that sh*t.Sum one needs to talk sum sense into your sis for puttin u in that situation.Good Luck.

I do think you were right but unfortunatly the racist slurrs could hinder you, however you say you had a audience & your sister was a witness, fight that @sshole & hopefully you can get people to testify on your side, and if your sister has any sense she will testify for you, he's an @sshole no matter what color he is & he's just trying to play a race card to win in a situation that he knows he wrong in, he never should have laid hands on your sister & his lazy @ss should be a man & get a job & play a productive part in society instead of trying to play a sorry escuse of a rac card & hope people feel for him because hes african american, hes a loser & I believe if you fight this case you shoul dwin as long as your sister & your neighbors testify in your behalf...best of luck sorry you have to deal w another of our lovely worlds dumbass's!!!BEST OF LUCK!

This once again shows how a low life uses the race card and gets away with it. I have a situation in my family with domestic violence, the man is white, I would never let him in my house.
Charges were pressed against him and he is serving time in prison. I am so sorry you lost your cool and he provoked you with the race card, he is a violent criminal and should be treated as such. You need to rescue your siter from this creep. I wish you had called the Police on him and reported him, then you would have a record of the incident, but by using physical violence against him, sadly you let the creep provoke you and stooped to his level. You should never be charged with a hate crime, get a good attorney and contact the Civil Liberty Union, they may be able to help you. Get anger management classes, next time
someone provokes you, you can keep your cool and win.

Get a Lawyer, A GOOD ONE, he can pop 10,000 holes in this case, and get it dropped to something like "Aggravated Assault", what happened, happened, so don't listen to everyone telling you that "you should did this, or you should have done that", just get a GOOD lawyer, if you have no past criminal record, you should skate without jail time, it might be expensive though, next time you know to just call the police, the guy prolly has "wants and warrants" out for him anyway, so he'll split as soon as you call the cops.

Sounds like you did what you had to do, and you should get off. You'd have kicked his @ss if he were white and treated your sis in the same manner...right? Sounds like he had it coming.

You should get off because of the extenuating circumstances, but I also hope that you get off because if too many people are convicted of trumped up charges, the public will become desensitized to the very real problem of hate crimes and make it harder to prosecute the genuine ones.

Obama supporters are not calling non-supporters racists, you're calling yourselves racist and claiming that his supporters are doing it. Get off your martyr's go - no person feels sorry for you. the only time I particularly have considered people calling Obama a racist is while they elevate his center call, his kenyan photograph, the call "Odinga" or affiliate him with black supremacy. All of those assaults ARE bigoted and may be referred to as precisely that. by using ways, i'm a former Obama supporter. So good success calling me an "Obamabot."
