i need to know how my fiancee can adopt my baby and be it's adoptive father when it is born.

If it is your current husband's baby, he will have to surrender parental rights.

Other than that, it's just a straightforward adoption. Contact an attorney who specializes in family law, and he or she can help guide you through it.

The only problem you will have is if your current husband does not wish to surrender his rights.
If that is the case, I suggest you approach it with him from the point of view that he will not have any parental responsibilities, including child support. However, if he still wants to be in the baby's life, and is willing to support it, I am not sure what you can do. Your attorney can guide you with that if there is a problem.

Are you giving him the baby? If the baby is going to live with both of you and be raised by the both of you, all you have to do is list him as the father on the birth certificate and give the baby his last name, that way when you get married the baby does not have to be adopted...that's why marriage should come first, to avoid situations like this...

NJ law says that the husband is the father of record DNA or not. He must give up rights for new fiancee to apply to adopt.You can have him relinquish parent rights as part of the divorce. If fiancee is DNA father just keep your mouth shut and list him on the birth certificate.

If you are still married and getting divorced, and if your child will be born during 9 months period after the date of divorce, your husband (exhusband) AUTOMATICALLY is considered as a father of the child. You need to consult some competent agencies about more information.

I think the baby's real father would have to grant permission first. I know that's how it used to be. You need to get yourself a lawyer on this one because it is going to cost you some bucks.
