Who, during your relationship, was the primary care-giver for the dog? Who first discovered the dog ... and decided to buy it? Most importantly ... who does the dog take to the best?
All of these things have to be taken into account, before deciding who gets custody of the dog ... especially if the dog takes to your ex more than you. Animals are like kids. You may not think they get troubled over a break-up, but they do .... sometimes profoundly. My ex insisted on keeping one of our Manx cats ... Junior ... and I took Tommy. I went to visit Junior a couple weeks later and he was skin and bone. He had stopped eating about a week after I had left. I cried ... and when I settled down, I told my ex that Junior was coming home with me ... he said he didn't have a problem with it. Junior gained his weight back within a couple of weeks. Like kids, you have to do what's best for them ... not you. Think about it ... before doing anything that may not be in the best interest of your pet.

If the dog truly means that much too you yes you can sue for custody of the dog.
Courts recogonize pets importance in divorce proceedings. If you purchased or adopted the dog and can obtain proof of this through checking or credit card statements for purchase or adoption agency records them be sure to get copies and ask the police if the will help you retrieve your pet. Be polite and just ask without arguing and she may also relent but above all try not to argue over the dog or become emtional or she may fight the ownership if she knows it bothers you.

hmm well... im only 16, so i dont know too much about that... but im a friggin HUGE dog lover, so id say get it back..
but what makes it YOUR dog? was it both of yours or just yours?
or maybe try threatening her first. tell her you'll take her to court if she doesnt give the dog back. and if she doesnt listen, then take action!

Can you request visitation rights? Perhaps have "shared custody" of the dog on equal basis.
