Planting in Autumn gives the plant a better start, but make sure where you are planting the other tree roots are not going to cause a problem for a new plant, maybe there is something else Shrub wise that would be a better choice. I guess it depends on the area you live in and what other trees you already have on your property. Dont you hate neighbours that make up thier minds to give others a hard time? ,,mmmm

Given that the conditions of your residence, I would hire a "professional" landscaper, referred by YOUR HOA, to come out, dig up, diagnose why your current pine tree died, let him replant a new tree.
THEN, if this new tree doesn't make it, YOU HAVE a receipt for the expense of this work done, per the HOA's contractor, to show you made an honest attempt to satisfy this concern, and any further complaints about this will have to be satisfied at the HOA's Expense.
This way you have legal proof, and might even be able to recover costs, since you didn't plant the tree yourself.

Fall is an excellent time to plant since it gives plants time to develop their root structure during the Fall, Winter and Spring. When summer comes--the time when plants really need to draw moisture from their root systems--the tree planted in Fall will be more developed than the one planted in Spring.
Think of it this way, the tree will be more likely to survive; you won't have to repeat this exercise (and endure the wrath of your nasty neighbor); and Nasty will be out of your hair sooner.

Here in Wisconsin we plant in the Spring.Planting in the Fall doesn't give the root system enough time to get established.If you are in a cold climate such as mine mulch the base of the tree for winter if you plant in the fall. Good Luck !

Your neighbors should mind their own bizzwax , but
a dead tree in the yard looks terrible.
Replace the tree with another kind of tree. Or make a flower bed, instead of plantin trees. U can plant shrubs.
U can plant a tree anytime, put plenty of mulch for the winter.

I believe what your neighbor is saying,with out saying it ,is that it will be in the ground all winter and will be coming up when spring comes around .Look it up on computer or at your local library ,,or a nursery..if it was me I would go in the forest and get me a small one about two feet and make sure you keep a lot of its natural dirt around it ..because remove the soil from a planet that it is use to being in sometimes shocks it and it will die ..Good luck

Check with a local nursery or Cooperative Extension. If you get a hard freeze in Winter I would wait. In much of California and the Pacific Northwest, this would be a great time.

yes plant in fall, then the trees can rest a while before growth time. the hoa can make you cut them so why bother replacing them?

take the bad one out now and wait till spring if we have a bad winter you may loose it. I would take it out and plant it upside down just for my nieghbors viewing satisfaction. Then I would ask them to put blinds in their bathroom window just to see the look on their face but say it in front of other people so you maximize the effect.

Sometimes you have to hold your tongue and do what others ask in a HOA to keep peace. Unless you plan on moving this winter, plant the tree and move on.
