Since he doesn't pay ANY support, I (grandma) pick up the tab to help fill their needs and it puts a BIG dent in my modest income. The father is a drug dealer (sheesh) for a living and has no proof of income. What can be done?? Any ideas? Help is appreciated!

Only the legal custodian of the children can sue the parent(s) for support. If the mother has custody, she would have to be the one to sue the father of her children to get support established. If you, as the grandparent, have custody, you could sue both parents for support. If the mother has custody, you don't have any obligation to give her money to support the kids, and therefore you can't sue for support.

If the father has no provable income, the person suing can ask the court to impute an income to the father. The same goes if the mother is being sued for support. Imputing an income means that the court will say that the person is capable of earning X amount of money, and can therefore pay child support of somesuch amount.

Simply go to your Family Court and apply for child support!
and where is the mother?
Doesn't matter that he is a drug dealer anyway. He lives somewhere. He can be served. Of course the courts are going to want to know where he works. It is doubtful he is stupid enough to admit that he is a drug dealer, But so what? If he is of age and can work for a living, that is what the courts will require him to do....( work!) If he ignores this opportunity, then perhaps a few nights in the local pokey will change his mind.

you are pretty much stuck. unless you can show an income the law will do nothing. you might try to sue him in civil court for the amount you have spent but if he has no employment the courts will have no where to garnish wages. you are pretty much trapped. its a tough situation but you will be very lucky if you get anything from him. get proof that he is selling drugs call the cops lock him up. hes better off in prison. maybe then he will grow up and take responsibility.

If you have custody of the children then you can file a claim through the court. If The mother has custody she would have to do the filing!

Are you the legal guardian? Because if your not I don't think you can. Since technically it's not really your responsibility to support them.

Why stop at the grandfather?

Sue the uncles, aunts and -- while you're at it -- the neighbors.
