The other half for sure will be for the spouse if it has no children, otherwise the children are also heirs. If they have no children, it will depend if the property was conjugal in nature. Conjugal in nature if this was acquired after marriage, if not then the relatives have an edge to contest. Anything conjugal will go all for the family or living better half.

Depends on the state they lived in. In GA the assets are split among the children as one half (jointly) and the spouse getting the other half.

It depends on the rules of your state. Here in Arizona, we are a community property state, so yes.....UNLESS your spouse has other children. If the spouse does, the children are entitled to their share as well.
It's important to own your house under both your names, with "Right of Survivorship" added...if not, those probate courts can really make your life hard.
