we broke up cuz he's seeing someone else. i told him i want him to leave, he's saying he won't and that i can't make him.
he said cuz we have a joint tenancy, if i ask to get his name removed, i will have to leave too as the agreement will have been broken. Is he right, can they do that?
I'm scared to ask the council cuz if it's true then i'll have nowhere to live just cuz he can't keep it in his trousers!!!

You are joint tenants therefore even if he moves out you still will be entitled to remain in the house. If you contact the council and tell them he has left then they will ask that he ends the joint tenancy and give you a new sole one. Best thing to do is speak to your housing officer and see what they say.

Joint tenancy
You may want to share the responsibilities of your tenancy with someone who lives with you. However, you should think carefully before having a joint tenancy because each joint tenant is jointly responsible for all of a tenant’s obligations under the Tenancy Agreement. For example, joint tenants are jointly responsible for the rent, and so if one tenant leaves, the remaining tenant will be responsible for any outstanding rent.

This can be problematic, you wont lose your house, but if you have rent arrears his name is unlikely to come off the tenancy. If you dont then he needs to write to the council asking to have his name come off the tenancy which in my experience doesnt happen too often, giving that you have high security of tenure. By that i basically mean that having a council tenancy is desirable and you have a strong legal interest in the property.

But you wont lose it if you have secure tenancy. Talk to your hosuign officer for more information, as this may affect also any benefits you have. chances are they already know about it anyway as council employees have good grapevine going on. trust me i work for a local authority, we generally know!

There's no reason you can't both agree to change the agreement to one tenant. The council will not just boot you out. They realize life happens. However, they might not be obligated to make the change.

And, your ex might not agree to it, either. He's right - you can't make him leave.

I suggest you approach the council to see what your options are there and to look into your own place.

he's right, joint tennancy binds you both to a contract. if i was you i would talk to the landlord and get in good. your ex has the right to stay there until the end of contract (lease) and under law you cannot sign a new lease at the end without him. so if he wanted to he could stay for another lease. one thing you could do is go get a restraining order, then after it is in tact call your landlord and tell him you have a restraining order, then most likely you can talk your landlord into taking him off the lease

please go a see a council officer. they will give you a form that ends his tenancy and keeps you as tenant. the council will help you. you will have to ask him to sign it to say he agrees. if you are too scare to speak to council go to citizen advice they are in the yellow pages. they can help. they will tell you about tenancy and yours rights and so long as you are up to date with your rent i know that council cant just terminate your tenancy. good luck!!!

i think as long as nobody has been abusive towards any body then you will have trouble getting him out and vice verser (dont think I spelt that right). Try and find out the definiton of abuse, if not i think you will just have to wait untill he gets bored with living there. Sorry not much help was it, good luck.
