SOME BMW keys do indeed have a battery in them to power the transponder. They normally get recharged when the key is in the ignition.
On rare occasion, the batteries do fail, and a replacement is necessary. There are a few (VERY few) locksmiths that can replace the battery, but in MY opinion, it is better to go to the BMW parts counter and ask them to do it for you.
It may be a little expensive, but at least you are sure of your security. After all, it IS your car.
