It happens all the time. The law doesn't say it doesn't happen.
Some girls do this because they regret what they've done later, or fear what their real boyfriend or parents might say.
To convict someone, you have to have proof beyond reasonable doubt. someone flaky enough to make up a story afterwards won't likely have proof. The police will ask for the whole story. Are there bruises? Cuts? Abrasions? Do they match how she claims she was held? Where's the weapon, if there is one?
She has to explain exactly how it happened. If she's making it up, she'll probably change her story as it goes on (like the Duke Lacrosse rape story). They quiz the victim over and over on details. After all, if they don't cover it, then the defence lawyer is going to trip her up instead. Nothing looks worse than a main accuser contracting herself on important details.
"He was holding your wrists down with both hands? How'd he get your clothes off? Your hands were stretched out? How'd the shirt come off? You hit his face with the hand that has rings on it? Where abouts are the cuts or bruises? He was driving the car? Why didn't you jump out?" Does the guy have a history of physical and abusive behaviour that others can verify, or is he gentle and caring?
In the Kobe Bryant case, the detail that the accuser had sex with other men before and after the incident, made it sound like it wasn't a traumatic rape.
If the case is too unconvincing, the police probably won't even lay charges - or else, they'll lay the charges and drop them, just to ruin everyone's life.

It happens and it sucks for everyone! Women: changing your mind does not allow you to cry rape! When you do that, you are making it harder for real victims. You are the reason so many women deal with the physical pain and humiliation of rape on their own. They never tell a soul. They would rather suffer in silence than be publicly humiliated by a system that has been abused and broken by women who drink more than they should and don't know how to say "no". Men: watch your backs. Know who you are bedding. If she's high or drunk don't waste your time. You don't need to risk everything for a few minutes of pleasure with a woman who could potentially destroy your life.

An official study in the Air Force in the 80's showed that in both the military and civilian life around 60% of rape charges are false.
This was true 5,000 years ago. Hebrew law recognized both rape and false charges of rape. Under ancient Hebrew law, if a woman claimed she had been raped in the out of doors, her word was to be taken without corroborating evidence or proof of resistance, because in the outdoors there would be no one to respond to her cries.
Note that this would truly motivate men to avoid women like the plague in the outdoors, which is not all bad.
If she claimed rape in town where there were people around, and no one heard her cry for help, it was ruled to be a false charge, and she was to receive drastic punishment.
Both sides are a bit harsh, but at least they had some recognition of rape, and of false rape charges.
Today, we have this big pretend game that false charges do not exist. Feminism sucks.

it does happen and it makes all of us look bad. In my opinion any woman who has been raped or personally known someone who has been raped would never falsely report a rape. We know the devastation rape can cause.
Rape can be hard to prove especially if it was date/acquaintance rape. The defense team tries to make you look like an irrational whore.
Alot of rapes are NOT reported for just those reasons. Many people still believe that unless there are broken bones or other devastating injuries the woman must have wanted it so it wasn't rape.
MEN-if the woman is high or drunk she may initially give concent but if she passes out is it totally out of it--STOP!!! Protect yourself and abstain until she sobers up.

Evidence.
The girl has to manufacture convincing evidence of forced sex or face the definite probability that the accused will deny everything and get off.
What stops a guy from raping a woman and then lying about it?
Same thing evidence.

Well like we all know there is no real truth in something like this. Either one of the two people are lieing or one of them is stretching the truth like your question. She might not have wanted to follow through with her actions so she stops and instead of blaming herself she blames the guy! Sound true? Nobody knows why another does such things but there is a definitely a difference between consenual sex and rape.

Rape, domestic violence, theft, assault, and any number of other crimes. Sad to say, most police, DA's, and victims assistance agencies WILL NOT investigate these allegations, for any number of reasons, if they are alleged by a wife/fiancee/girlfriend, for any reason. Something to think about before you get involved...

Rape can be detected shortly after the act. Then it is up to the judge if he believes the victim or the assailant.
