She's tried to kill herself, abandoned him for weeks without calling or anything, put him in several dangerous situations all of which i have documented and have wittnesses including her own family.

Possession is 9/10ths of the law. When I separated from my wife I took the kid with. Knowing she couldn't give her a better life than I. I had no trouble keeping her, BUT it did cost a lot. Find the "Johnny Cochran" of family law where you live and document everything, have the kids write notes or communicate what happened i.e.pictures, If a situation is going on call CPS Right away. To take custody of the kids you will be in the fight of your life, it will cost a lot get big credit cards now and worry how to pay for it later your kids depend on it. Never say anything you can't substantiate, always be professional. Witnesses need to come to court so they may be cross examined. Good luck

If she's so screwed up, what makes you think that she going to try and take your boy? Has she given any indications, made any threats, comments?
There's nothing that she can do unless she files papers with the court, and then you'll both have to stand in front of the Judge. Can she even afford a lawyer? If you have all of this documentation & witnesses, I don't think that she has a snowball's chance in hell.
FYI - keep your documentation safe. Keep it in a safe and have your folks keep certified copies (just in case).

When it comes to custody battles the courts have no interest in couples who take revenge on one another generally, however, the safety and well being of a child is a defining factor. I would say that if you feel strongly about this, and the safety of this child you need to do something and quick, before something really bad happens.

keep all trhe documentation and give to your lawyer . contact your local dept of social services to report the situations also most states when a child is involved will have a guardian ad litem which is a lawyer in the childs best interest and their word generally is number one with the courts. so check into that i did that to stop my ex husband from seeing our son he had to see him in the presence of a social worker and limited time frames too. so it sound bad but everytime your child is in danger you need to report it . for the safety of your child.
