When the constitution says that business has a right of free speech and a legislature says that tobacco companies cannot advertise their product on TV, which law takes precedence?

Because the FDC ruled against it and the Supreme Court upheld any challenges.

Trust me, tobacco companies will not be fighting that today. People would go nuts, including myself, if they tried.

Free speech should take precedence over all. Unfortunately, too many people in power think it's best to not offend people who don't smoke. I don't smoke, never want to smoke, and I hope my future children will never smoke. But the way some people attack tobacco companies is pathetic. No one today smokes cigarettes without knowing exactly what it's doing. If they still want to, then leave them alone.

Just because it's unheatlhy, so what? So is alcohol, but look at how many beer commercials you see on tv. And heroine dealers is a BIG difference. Heroine is illegal. Tobacco isn't.

Advertising has nothing to do with free speech. Now if in the constitution it said "right of free advertising" then things might be different. Besides, who gives a flying monkeys @$$ if they can't advertising on tv? I'd be perfectly ok with making tobacco illegal in all 50 states. It's slow suicide to the smokers and death to us innocent 2nd hand smoke inhaling bystanders.

Smoking is dangerous to the health and it was the reason why advertising on TV was prohibited.
