Because they tried to ENGAGE (intent to have sex with a minor) with the minor. At this time, there is no evidence Foley tried to engage with the minors. It was just talk. I see though, where it doesn't seem fair. I think they should make an example out of him, that no one gets away with it. Did you know Foley did an interview with John Walsh talking about sex predators preying on children over the internet? I can't believe him!

Foley has resigned as he should have. Congress is investigating as it should. Police and the FBI I believe are investigating what is within their juristiction. Charges are likely to be filed when the evidence is there to make a case for legal action.
As of now the emails from 3 years ago were not enough to cause any action from the FBI or any great concern from the parents. The recent im's occurred after the page turned 18. That would make it a private consent matter while still being disgusting.
The reporter who broke the story had the information back in August. Why the delay in reporting allowing him more time to potentially abuse other pages? Now it turns out that the im's may be a fabricated hoax. The page has retained a lawyer. We don't know the whole story on this yet.

Having a dialog with someone is different than having sex with someone. I agree that it is still slimy but under the freedom of speech, it is legal. If the conversation is with someone 16 or younger, that would be in violaton of the law in most state. In DC, 16 is the age of consent.
For the ordinary citizen, probably nobody cares. However, this is DC and election year. Just some extra fuel to the fire.

He didn't have sex with the kid, and from what I see on Drudge, the Instant Messages may well be a hoax anyway.
It's not like he was after a 12 year old, the guy was of legal age.

On CNN they informed just a while ago that the age of 16 is of legal consent age in DC to have sex. So he did not break the law. AND he didn't have sex with anyone (that we know of so far). I'm shocked that you can have sex in DC at 16 but other states it's statutory rape. Everyday amazes me.

He has not broken any laws. Gerry Studds of Mass. did about twenty years ago. He admitted having sex with a 17 year old page and tried to have sex with two others.

He hasn't been found guilty by a jury of his own peers yet. When he gets out of rehab .. he may stand trial. He didn't go to anyone of the Intern houses .... that we know about yet. That may change. Good Luck! :)
