Did they cause your fathers death through some sort of negligence?

It depends.

In most states if your father was a trespasser, then the owner would only be liable if he intentionally harmed your father. If he was a licensee (or guest of the owner), then the owner would be liable if he failed to warn your father of a known hazard or otherwise negligently caused your father's death. If your father was an invitee (ie. for the purpose of doing business that would benefit the owner), then the owner is liable if he did not exercise reasonable care in maintaining the premises or failed to warn of a danger that he knew about or should have known about.

In any case, the owner's action or inaction has to be the proximate cause of your father's death. If your father died of natural causes, or if he caused his own death, your out of luck.

Only if the proprietor is liable in some way. So what has to be determined is 'did the proprietor cause the death of your father?'. In any event you will need to consult a lawyer and instruct him on the particular circumstances of your case.

it depends on if the person who owned the property had a duty that was breeched and his failure to perform the duty resulted in the death of your father. You must also be able to prove your claim in a civil court.
