A friend of mine is in jail - for (two non-violent misdemeanors)..
ANYWAYS: The circumstances surrounding his arrest, guilt or innocence are not the point, The point and question involves the fact that he applied for a publuc defender the day he was arrested. And the Judge was aware that the public defenders office was unable to represent him,as they were also representing his ex-wife (on a different case)... So the judge's duty was to then appoint my friend assigned counsel (by the court)..

43+ days later my friend STILL has not had the opportunity to see a lawyer and hes been at court hearings for this case 4 different times (each time, the **** gets adjourned)... NOW hes got to sit in jail another whole month and 4 days before his NEXT hearing..and to this day has NOT had access to an atty- and cant afford to hire one! Does anyone know the correct course of action my friend can take under these circumstances?? Your thoughts are much appreciated.

FYI: I know everything about this man's charges. And hes not gotten arrested for anything other than overdue child support!! NO FELONIES- **EVER*** But Im grateful to the person who's accused me of lying about this; It just validates what I already know: That he DEFINATELY has a good case against the court!!

I he can he needs to raise some money then he can get out of jail.

He can always have bail posted so he can wait outside and not in jail. If they truly are misdemeanors bail is not that much.

The court systems are a mess right now and the public defenders are over worked. A real lawyer should not cost that much and will expedite the the process as long as the charges are misdemeanors and there is no other history.

Tell him to file a motion for a speedy trial, He can do that on a piece of paper, even toilet paper, and the judge will be forced to appoint him an attorney to satisfy the speedy trial rule. A motion filed in a letter written to the judge is just as effective as one filed by an attorney to preserve his rights under the rules of the court.

Look U R there and U can very well hire a lawyer and get bail, Why r u wasting time. Can't u not hire a lawyer for ur friend .

it's part of his miranda rights. he has the right to an attorney. they can't charge him with anything if they are denying his right to an attorney. he should be call every lawyer in the book. i guarentee he tells his story to a lawyer, the lawyer will for one get your friend off, for two countersue the city for wrongful imprisonment

he can call a friend of mine, collect and ask her to refer him to an attorney 1-904-216-8424, tell Debbi that Mark referred him

sounds very suspicious. what are the charges.... not what he told you but the actual charges.....sounds like the two non-violent misdemeanors are a probation violation for his violent felony conviction either you are lying to us or he is lying to you....

he has a right to a fair trial..its a constitutional right..ie. he has a right to a court appointed attorney, if he cannot afford one

Not real good at this stuff---i hate the courts, police and all associated with it..................What is the right to a speedy trial, might check into that..............??

he should talk to a lawyer anyway,ask for a pro bono he should have a right to one

He needs to bring this up with the authorities. Hey, if you can't do the time, don't do the crime.
