If you have already sent the item there is a big problem. In order to sue in small claims court you must file where the defendent lives. If they are on the other side of the country it is not practical. That is why it is always better to make sure you have received the money and that it clears before sending anything. That is a disadvantage for the buyer since a seller can be dishonest too. That is the purpose of ratings on eBay.

like others have said, report them to eBay. and make sure payment is received or verified before you ship your item(s). over my years of ebaying I've come into contact with a few folks who are just out to get something for free. be careful out there :)

If you did not send them the item yet cancel the sale. However if you did send them the item you may have to take them to small claims court. Unless they bought it under an assumed name then you are out of luck.
