Going through someone's garbage in their home would be illegal, but once you have put it out on the curb, it is considered public property.
What you want to be concerned with is the fact that littering is illegal. Try finding a cop that will arrest homeless people for dropping garbage on the ground, I'm sure they would be happy to help you.
P.S. If y'all recycled, the soda cans wouldn't be in the garbage and the "bums" would eventually get the hint and stop looking there...

It is not illegal to go through garbage out by the curb. It IS illegal to throw trash around.
Don't you feel bad for the homeless at all? They have to live on trash... it's sad. Instead of trying to write tickets for people who can never pay them, why not get to the root of the problem-- why there are homeless in your neighborhood in the first place.

Nope once its in the can and out at the curb its up for grabs. I try to set things aside that I think the homeless may want, like cans and clothes so they don't rip my garbage apart. They respect this and I feel good having helped them a bit.

it should be because people do it all night there is at least 5 or 6 differant people going through it all nite and yea some do make a mess and they leave the top open , and most of them aren't homeless they probably have more money then most of us if it was a homeless i would understand . i see alot of women that dont under stand get out of my trash cause they dont speak english so they say . i think it shouldn't be allowed then they stick their bare hands in there not knowing what the hells in there thats sick .

Actually...at least in Santa Barbra, California, it really is illegal to take stuff from recycling bins, but then again that's just Santa Barbra. It turns out alot of people taking/stealing the cans, according a newspaper over there, were rich, suburban/white kids, toting their recycled goods on the back of their high class cars. I really doubt that's true but why not have a heart man.

Nope. Garbage is fair game. However; if you live in a complex, you can have the person arrested for trespassing. If you just put the cans in the street in front of your house the night before, they are fair game.............

Once you have placed garbage on the curb it is abandoned property and anyone can rummage through it, however, it they have to physically come on your property to rummage through it that is trespassing and you can call and report that.

it is not illegal to take someones trash.....it is considered unwanted property, however if it is on your property, you may be able to have the person charged with trespassing and be issued a no trespassing warning. I would call your local police dept and ask them what you can do about the situation, they may also up the patrol in your neighborhood
