his sister and her hasband are very controlling and are just worried that they won't be able to control the money, me and my boyfriend don't care if thay continue to control the money. We discussed with them the marriage and they were all for it, but we had to go to probate court to get the courts permission, and they told us to write a letter and that we had to serve the guardins and let them know, they didn't say anything, then the next day, they came to the house with there own letter, saying no, tha that they decided against it, basically cause they will loose there control then.

As far as I'm reading it I'd say you already answered the question yourself unfortunatly.

But the best answer I can give you is if you still don't know go find an answer from an actual person with legal knowledge for your area. Everyone on here can guess but I doubt any of them know all the facts and areas enough to help you.

You said in your question that if you guys got married then your boyfriend's sister & husband would loose control over the money. It sounds like you guys are already living together because you said "THEY" (I'm assuming your boyfriend's sister & husband) came over the next day (I'm assuming to you & your boyfriend's house or apt). It sounds to me like your boyfriend's sister and husband just want the money - but, being as you guys had to get it ok'd through the court system to get married you guys sound like maybe your awfully young?? If you are old enough to get married - get married & then have the checks put in your husbands name and keep the money for his disability yourself - why should his sister & her husband benefit from what should be righfully your boyfriends money. But, actually it sounds like you guys are too young to get married if your boyfriend has a guardian - people only have guardian's if their underage. If this is the case - and you guys truly love each other - wait until your of legal age, you 18 and him 21 and get married - THEN YOU WOULDN'T NEED THEIR PERMISSION AND MAKE SURE YOU HAVE THE CHECKS PUT IN YOUR HUSBANDS NAME - sounds to me as if your boyfriend's sister & husband just want the disability checks.

if he's over 18 i don't think anyone can say he can't marry legally. Just call legal aid and ask them they answers questions for free. I'm guessing his disability check is for a mental disorder or a learning disorder you don't get a payee "someone having your money" unless you have a very low IQ or you are pretty mentally unstable. You need to think this out your INCOME WILL COUNT AGAINST HIS CHECK he could lose the whole check if you make to much S.S.I is based on household income CALL s.s.i ask how this would effect the check. My sister in law lost her S.S.i WHEN she married my brother he made 46,000 a year he now fully supports her.

It all depends... Does she just control the money or does she have power of attorney as well? Does your bf have the right to appoint a new POA? Whatever the case, I'd suggest you seek the advice of an attorney to find out what you can and cannot do in this case.

How old are you both? You sound like you are both underage. If not, then petition the court. Get your own lawyer. They have no right to his money. If you both are of sound mind, then there is no reason for them to control anything, so something here sounds funny. If you are both underage, then just wait for him to come into his majority, and get married then. There's no rush, marriage is suppose to be forever.

Lots of questions here,
Is he age of majority?
Is there a mental component to the disability?
Can you two live alone afterward?

All questions which need answered. Not here but to the court.

She sure can and from where I'm sitting she is doing what is right for her brother. She is his legal guardian and I suspect she feels that you both are too immature to get married...from what you've posted I would have to agree with her.

Speak with an attorney. If your bf is of legal age, even if he is disabiled, I don't see why any one could stop him form a happy life and marriage!!

Get legal advice. If he's not old enough, wait tell he is.

if your boyfriend is old enough to get married then no ,its obvious they only care about the money.
