If you are using work phone to make this calls then your company can listen, record or do whatever they see fit because everything you use at work belongs to your employer.
I know many of us tend to sit at work during our lunch time and each lunch in our office or whatever. Just the fact that you talk during your break time does not negate the fact that the phone you are using belongs to the company. Just like you using company computer to do none work related things. The company can monitor everything you do on the computer without you knowing.
If you are using your own cell phone in your office during your break time, then go outside and talk. That will stop the boss from hearing your conversation.
There is nothing illegal about companies taping conversations going on at the work provided phone. As long as the equipment used belongs to the company and during company time that you are getting paid for... it is all legal. The HP case is different... they were wiretapping private phones.
Must companies now have NOTICE CONCERNING COMPUTER USE AND MONITORING policy that they make sure that everyone is aware of. Something like this... and this will relate to all things that belongs to the company.
Example:
As indicated in the policy, Company may monitor use of company networks and individual computer accounts and activity.
If you want to ensure your personal e-mail and internet activities are not monitored by company, you must use a computer not linked to company networks and an e-mail address not provided through company.

Nothing is personal in an office. That is HIS phone (or the company's phone) and even though you are on your lunch break, it's still HIS office and HIS phone. What if you were conducting drug deals over the phone on your lunch break? he has a right to know. There is no such thing as a private phone call in an office. You want to make a private call, get a cell phone and go outside. and it's not illegal for him to listen in. That's like saying you should be free to surf whatever porn site you want on the office computer because you're doing it on your lunch time. For all we know, you could be making obscene phone calls during a break. If he supposed to just turn the other way?

He is not breaking any law and has the right to monitor all activities on his property. They can take video, photographs, and even listen in on your conversations. The only place they can not do photos and video is in rest rooms. They should always stop listening when calls are of personal nature, however, he can reprimand you for making calls on company time. Company time includes all paid breaks. If you do not get paid for lunch and are compensated for all other breaks..... that is when you make phone calls. Paid breaks are still his time.

Unfortunately, some bosses have to do that...the ones that do it for security of the company or employee's misuse. However, if neither is the case and he is listening in on personal stuff that is not injurious to the company...it could be considered intrusive and kind of WRONG.

I think that they are a nosey boss then. If it's your personal time, than that's your time. I think maybe you should speak to your boss about this, it's obviously an issue for you, and being your boss or not, you need to address it. HOpe that helps! :)

In my opinion, even though you are at work, your boss should not be listening in on your calls. Even though some companies do watch over their employees emails at least their employees had to sign stating the companies privacy laws. If it bothers you then you should ask about an employee hotline number to complain.

There has to be a law this ahole is breaking!
I'd confront this boss. And go over his head, if at all possible.
It's against the law for our own president of the USA to listen in on ****, so why allow this at your work place.
Let him know he's breaking the law!!

They can be personal calls on your own time at work, but if you are using company equipment it can be monitored. If you are using a personal cell (mobile) phone, then I'd walk outside to make my calls.

Unfortunately, if you are making the calls on a company phone then there is nothing one can do about it.
However, if they are doing it when you are on your own, I would advise them to not do so.
(If I had another job lined up, I would get an air horn and blast the MF in the ear.)

why are you making or recieving personal phone calls at work ? That is not what you are there for . You are there to work right? So therefore he feels as though you are recieving personal calls on his dime so to speak. Stop it and get back to work.
