If the father is willing and able, he will get the child. It wont matter whats in your will. He is the father.
Now if there is a reason that the father cant or wont take the child...then there is a chance the child will go to the state. Unless you have family who will go to court and tell them they want the child.

The child goes to the other parent legally. In the event that that person doesn't want to take the child or cannot take the child, they will ask the next of kin. They will try every living and capable family member, but if none of them can, the child will go to foster care, or possibly adopted.

the child will go to the father and if he is not available the nearest relative that wants him and if no one wants the child the child will become a award of the state.. so this should probably move you into getting a will or a living trust.

All close family members will be given first oppertunity for adoption. In New Jersey, the order is
1. Father - automatically... as long as living.
2. Siblings
3. Parents (depending on their age, could be 2nd choice)
4. Cousins*
*Cousins are only blood related, not married in. If your first cousing gets married and passes away, the spouse is ineligible.
If all decline, then they will become property of the State.

In most situations, the child's Father would be sought after, then the next of kind in your family is what usually happens. It would be better if you would ask someone you trust if they would take this responsibility so you could have peace of mind regarding this situation.

Make a will, today. You do NOT want a judge to make decisions concerning your child if you get killed tomorrow. Just DO IT!
Your child may still have the father but you need to spell out your wishes befiore it's too late.

It's very likely your child will end up with the father. It's very important you have a will made up if you want your child to be placed elsewhere.

If you're worried, you should consult with a lawyer and find out what your options are.
I am not with my children's father and I have full parental rights (he has none) and I don't have a will either, from what I know, my family would take my kids if something were to happen to me....and I live in Canada, so I guess it also depends on where you live as well.
