i am owed back pay. My ex is a lazy bum that doesn't want to work. somehow he got away with getting ssi. i was getting 65% of his check becouse he owes so much then the kids get ssi becouse he does. we went to court tues. and they said i am only supposed to get 75.00 a peice for the kids but since he owes me back pay they will take 175.00 out of his ssi check. so now i am only getting 325. a month for two kids and the last four months i was getting 639.00 . why can't i get the 65% i am entitled too. i have one step son that we have to pay more child support to than i am getting for two kids. don't you just love dead beat dads. any way i just got done writing the irs a letter about how he hasn't paid taxes in 5 yrs becouse he owes me and another girl back child support.

he doesn't pay support for any other kids his girlfriend also gets ssi and she is pregnant so neither one of them has to work and when they have the baby it will get ssi too. i feel sorry for the baby having to grow up with two deadbeats.

the % all depends on several things

1...the number of children you have
2...the number of children total he has to pay support for
3...the state you live in

My ex has not paid child support since Nov. 2004, he JUST went to jail for it in June and was released on good behavior in Aug. In the beginning he paid the full % allowed based on his income. ($660 for 2 kids) They will only take into consideration the bills they have to pay (rent, car payment, utilities, etc) At one point he was paying less than $250 for both....

Its a constant battle to get what you deserve, but the best way is to contact the child support agency that handles your case and call them....call them everyday every week...whatever it takes. if that doesnt work then you call the Attorney General and file a complaint. When that is done they HAVE to check it out. Here are some sources I used when trying to collect support, but please remember this is for Texas Child support, but it should give you an idea of where to look in your state.

Another thing....if you cant get results with the agency or the AG's office...call your state rep's office...they can do the same thing...light a fire under both the AG's office and the agency's a**

The uniform amounts for child support say that you should be getting 33% of his paycheck, but it may be adjusted down in certain circumstances. I don't know his circumstances, or how much he gets from ssi, either. Plus, even though he owes you, there are limits on how much money can be garnished out of someones check. Also, since he also is probably supporting some other kids, that screws with the amounts, too. I am not defending that ******, I'm just telling you the law. It chaps my ***, too. People think mamas get a free ride in court but we don't, we get ****** there with regularity, too.

The rules are max 25% of there take home pay regardless of amount of kids, But will only be higher if back pay owed as in your case and also theres a minimum amount the government says people need to live on per. week that no one can touch. sorry not sure of that amount.
