repost, to make more clear....My brother lives in another country, his ex wife and 2 kids live in florida. she ripped him a new hole when the divorce was done, Can he be held in contempt for not sending her the alimony part of the payment? IF he were to come to the states, can anything be done (like arrested?) He pays his child support as ordered without question. She just lied and had fake papers for the judge showing she was a poor woman being left out to dry, she lives (and always has for 18 years) in an OLD trailer, and lives on her family's property. She is getting 2000 a month alimony and he only makes 3600 a month??? IS THAT FAIR? HELL NO! WHAT CAN HE DO?????

Better... No it is not fair and yes he can. Someone on his side needs to get a lawyer involved and reopen the alimony part of the divorce decree. In a divorce nothing is set in stone, things can change, with court orders. Get the evidence which will help your brother, If he needs to come back for the hearing, be sure that his lawyer meets him and has spoken to the Judge over the case with all this information. This could keep him out of jail.

As for him being in another country, like I said before, she would have to go through the court and have him extradited to be able press charges against him, the court will not take it upon themselves.

He needs to get a lawyer. And until he goes before a judge, he needs to pay. Sorry, but that's the law. Does this woman not work? Alimony in Florida is difficult to get unless she has no skills. Then only until she goes to school and learns a skill. He definitely needs a lawyer.

your brother had a right to appeal the decission of the court! he has no recourse for a reduction in child support,he owes his kids a life..glad to see he is a man about it..he can be arrested once returning to the states if she has a order of contempt against him..welcome to a country where a father can be jailed to debtors prison for violating a payment schedule..this is unconstitutional and being fought but has yet to be won.,the feminest movement of the early 70's thru the 80's has reduced a fathers rights to less than that of a terrorist..sad huh?but yet they want equal treatment,while financialy sodemizing the fathers of america..you have the most liberal judges in fla..wouldn't surprize me if it was in dade county..good luck but he can be arrested

In any civil case, the more documentation you have, the better. If she is living rent or mortgage free, get it documented. If she is receiving income beyond what she has reported, document it. Your brother may have some serious legal problems if he doesn't get them handled, even if his dispute with his ex-wife gets settled in his favor. So, get your PI hat on and get busy!

An attorney can straighten this out ~ ~ and believe me it will
take an attorney.

Check with the local (state) county office for legal aid, they will
instruct you with the best info.

NOT FAIR, HAVE HIM FILE AN ADJUSTMENT ON HIS ORDER. PROBABLY NEED AN ATTORNEY.
