Technically, you wouldn't be a "student" any longer if you were eligible to take the oath. You would have completed school and be a medical school graduate. As a medical school graduate, you would be required to take the oath.

I would sure hope so! I think it underlines the responsibilities someone accepts when they become a doctor, and if they didn't take the oath, it would be a decline in the morality expected from one.

Yeah, but if you take a look at real life (easier to rent the John Q. movie though) it's a joke. Sort of like promissing something with your fingers crossed.
