John owns a duplex. He will only rent to someone who is only 55yrs or older. Can he legally do this?

Only if the property meets state or federal guidelines. Landlords cannot discriminate on age unless they have gone through the process of obtaining designations as a seniors housing property.

You are wondering if he is breaking any Federal Fair Housing Laws (Civil Rights Act of 1866).

Yes John can legally do that. (if he or a family member resides at the adjoyning unit.

The New Jersey Law Against Discrimination does not apply to:
1. The rental of a single dwelling, if the other unit is occupied by the owner as his residence or the household of a family at the time of the rental.

*this would not apply if the dwelling was built or substantially rebuilt with the use of public funds, or was financed by a government-insured loan.

Depends on what state you live in all states handle housing laws differently
some states are like the equally opportunity no discrimination
and some aren't

if there is a law in effect if that person trying to rent can prove he said this witness etc.

he can take him to court which can result in fines
or even money to the party trying to rent the property.

the owner can call it a senior building and it is legal....if the other tenant is 55 and older, there is nothing anyone can do, however, if the other tenant is under the age limit, then you can sue them
