Their supposed to be three equal branches with separate but equal powers. Have you heard the expression ---Absolute power corrupts absolutely? Who'd a thunk that one party would be able to retain the Executive, Legislative and have an advantage on the Supreme Court that exists today? Our Democrats don't have any majority on any committes in the house or senate so their bills are shot down b-4 they can be debated on the house or senate floor. We are basically screwed until November--that's why I encourage even the stauchest Republican to vote Democrat just so we can have a patriotic/purist functionality to our gov't.

There are certain laws such as:
Right to protect agains ilegal search and seizure
Right to Habeas Corpus
Right to bear arms
etc... that explicitly give citizens rights that the government cannot (supposedly) take away.
