we need to have the disk I think to put the software onto the iPod, so where can I get a free download or buy the disk?

Go to apple.com, then to the iTunes section. You can download it from there.
I got a new computer a while back and downloaded the software for my iPod from apple.com, having lost the actual disk a long time ago.

all you need is iTunes. Apple.com has it there. It's free. Hope you have high speed connection, it's a big file. Once that is up and running, you can plug in the iPod and iTunes will "see" it.
