Hello all :) - I live in NJ & had my son 4 months ago. 2 day was the 1st day in court (Im going for custody/child support). I have'nt spoken to my ex. Boy Friend since Jan. (He would not return e-mails or calls). My ? is ... Up until 2 weeks ago he was working 2 jobs. 1 full time (for years now) & 1 part time (for the summer). He no longer has his part time job (I believe he might of been laid off for the fall/winter). It will be several weeks before they figure out an amount he has to pay in child support (paternity has to be done first). Will the court only ask him for his last few pay stubs - Or does he HAVE to show ALL he's made? Im not sure if they only go back a couple of weeks - because by the time they figure the amount out, his second job will no longer be in the time frame within the last few weeks (instead it will be about a month or 2 later). AND am I able to "mention" to the court that he did have this job "months ago" **or it will be months ago once all is calculated.

My son is in NJ and paying child support. The judge at the divorce just asked him how much money he was making and if he could afford the amount agreed upon, that is because he agreed on a large amount, as he wanted his girls taken care of. The judge did not ask for any proof of his income at all but may have known what the general pay for his kind of work is. I was there at court with him so this is not a second hand story I am telling you.

I've been to court a few times for child support, I've been in FL though and KY... I dont believe that you are entitled to money from his second part-time job. I believe you are only entitled to money from his full time job.... And they will ask for several paychecks probably... and get an idea of how much he usually makes. Make sure you ask for an income deduction order! Dont let him pay on his own! Good luck!

It is calculated based upon the income at the time. However, if he is unemployed he MUST keep his job or they will help him find one. If you have a lawyer then you should speak with him or her. I also found some interesting information on www.njchildsupport.org. I believe there's information there that can answer any additional questions or concerns that you may have.

what if he says: your honor, now that i only have one job i have plenty of time to care for my child and it is only fair to share custody 50/50...it has been four months and she still doesn't have a job.
