I live in a 3 apartment house. Is this considered a commercial building? I ask because I am having a problem with the landlord not correcting a sewage leak that caused damage and mold. To see if this would apply. http://www.epa.gov/mold/mold_remediation.html

I believe it is considered residential for your purpose.

If you live there, it is by definition, residential. In most states, the landlord is under a duty to provide a habitable place for you to live. If the mold is posing a health risk or otherwise making your apartment unlivable, then you have a cause of action on your hand should you be forced to vacate because of his inaction. My suggestion would be to put everything in WRITING. Create a paper trail a mile long. That way, if push comes to shove, you have ample documentation. Make sure you take plenty of pictures of the damage. Also, check to see if your state has a landlord tenant act or other statute which outlines your rights as a renter.

It's residential.

That link applies to remediation methods. It has nothing to do with the landlord's responsibility to remediate the problem.

As stated on the site, although it's written for schools and commercial buildings, the methods apply to other buildings as well.

The landlord is required to provide a safe living environment, free of health and safety hazards.

I'd suggest that you contact the local building inspector if the landlord fails or refuses to fix the problem. The landlord has to fix the problem, but is not liable for the damage to your personal property.

an apartment house IS not considered as a commercial building. though you can complain to whatever agency that checks residential buildings. Complain about health and sanitary of living there.
