Look up the Family Medical Act. There is no reason he can't be there. That is what there are substitute teachers for. I believe that there is a section that states that he cannot be penalized for taking a day or two off work for a child's birth. Check into it, and see if he can take a vacation or personal day. His employer has no right to tell him that he cannot be there for his child's birth. If all else fails, have him call in sick to work when you go into labor. They cannot stop him from calling in sick! Good luck to you. Congratulations on the baby. I really hope he gets to be there with you!!
Check out this site. It clearly states that an employer must give the employee up to 12 weeks leave for the birth of a child. Read all the rules and then bring it up to his boss if he still refuses to give him the time off. Good Luck!!!!!! : )

Family Leave Act passed under President Clinton says that an employer must allow your husband time off for birth or adoption of a child. Am I assuming too much? I don't know if you are in the US, but if you are, then tell hubby to get a sub lined up.

He should talk to who ever coordinates benefits at work. He should also probably talk to the principal. I'm sure something can be worked out. Don't panic when you don't even have all the information yet. Unless his school is TINY, then FMLA should probably apply to him which says he does legally have the right to take the time off without pay.

I would suggest that he speak to the Human Resorce office and ask about his Family Medical Leave qualifications. I know that typically you must have worked so many hours with in a certian amount of time to qualify but Most of the time Fathers ARE allowed time off-- My dad works for a public school system and he was allowed time of for me-- his daughter!! So just ask!!

I don't mean to be rude, but my husband is in the US Army, currently deployed to Afghanistan. I gave birth in July 2006, they promised him that he was going to get to come home. But they wouldnt let him. He missed the birth and the first 6 to 7 months of his little girls life.
My advice, talk to the school!

Family leave act says he can take time off... 30days notice more is better, just incase of paperwork problems
I'm in Missouri and a male teacher
The real question is if he will get paid... my school allows time off with pay if I have built up sick days to cover them... I still have to plan for my absence and grade papers :)
We also have a sick bank to pull from but must be paid back later
Besides time off he needs to think about his retirement system.. if he takes time off and doesn't get paid it messes with the amount of credits he may get for retirement

He should be able to take the day off! He would just need to get a sub. It shouldn't be a problem.

I don't know about the rules, but there is no way that the school will make their employee work the day that his child is born.

The school usually gives off a couple months or so of "Faternaty leave" or whatever. Consult your school/district's administration.

I'd get him to talk to the school....I don't see a problem with that.
I had my two children and my husband was not there....he was in Iraq fighting the war.
