I have a new logo that I want to use on a clothing and accessories line. I have no money now, but I want to trademark or copyright it now so that it's mine and I can work with it later.

That would be a trademark and NOT a copyright. To register a trademark, that's done either through your Secretary of State for a State trademark or the US Patent & Trademark Office for a Federal trademark.

If you are only conducting business in one state, then a State trademark is most appropriate. If you conduct (OR are planning to conduct) business in at least 2 states OR between the US & any other country, you can file for a Federal trademark.

Prior to investing your time, money & effort into a name, it is strongly advised that comprehensive research be conducted to ensure that the logo you're interested in is truly available.

This entails searching the pending & registered Federal & State trademark files. Then, if clear, you can decide if you would like to file for a Federal or a State trademark.

first you must do a thorough search to see if your logo has been used anywhere. If so, you may want to change one little thing like a finger placed across your lip logo as if your saying shhh!

A place to start looking would be in your capital where you live. See whats registered.(like Florida is Tallahassee. New jersey is trenton etc)

Once you've done your search and you know you are clear. take your logo and mail it to yourself and never open it.

The post-mark on your returned letter will mark and date your logo as yours. I hope you're hearing me. It works and it'll cost you an envelop and a stamp.
