I have been working for my employer for a year. I am asking to take off 2 days to see my husband who is in the military and coming home on leave. He says I cant and if I take off I will be fired. Is this fair ?? Can he really fire me over taking off? Im not sure of all the work realated laws and need advise..... THANKS

He can fire you and call it a "no show". I would take the satisfaction of calling him a dick as you walk out the door.

You have a lot of very supportive answers already, and I agree with the general tenor of them. I don't know how much you need this job, or how hard it may be to get a job in your area. But unless there is some compelling reason to do otherwise, I'd take the time off.

If you get fired, file for unemployment compensation. And if the employer contests it, invite a radio, TV, or newspaper reporter to the hearing. This would make an interesting news story. And also, if you do get fired, write a letter to the Secretary of the Army (or whatever branch of service your husband is in) and tell them your story. Also send a letter to the news chiefs of all the TV [networks and news services. [Be sure to tell Steve Hartman of CBS -- he does some of the best work I've ever seen on TV.] Somebody will pick up the story, and that will shame your boss into doing the right thing.

Your employer sounds like a self-centered and cruel person. Some companies have various rules and regulations about time worked and taking time off; but this should be a time that the rules could be bent just a bit. It may not be fair, but companies can fire people for all kinds of reason, although this seems especially heartless. If you have any time due to you, call out and then look for another job and tender your resignation as soon as you return to work. I do not believe that I would want to work for an employer who is so inflexible and cruel. You may want to check with a legal aide office in your area, to be sure of all the rules and regulations. I wonder if your boss knows how lucky he is to have other people putting their lives on the line for his???? Obviously not, or he would be a bit more flexible with your request. Well I know the job that I work outside of my home gives us a certain amount of time (vacation time/sick time) a year. If we use all of it and something comes up, we get written up. If we do it again your fired. So if you work for a company that is like this, then yes, you can be terminated (if you are out of hours). Most jobs and when I say most I mean about 90% are at will employers and they can terminate anyone for any reason at anytime. I wish you luck! A boss can pretty much fire you for any reason. It isn't fair though and your boss is obviously an ***. If you have paid sick days call in, otherwise do you really want to work for someone with no heart? I'm happy your husband is coming home safe.

it sounds like your boss is a real prick, i wouldnt want to work for him anyways. I know how hard it is having someone away for that long, and chances are it is legal for your boss to tell you that you cant take off work, unless he is violating any sort of time laws, this may be a choice that comes down to your principles. You could really piss your boss off and just bring your husband to work with you.

I'd let you leave, but I would be thinking this:

She is taking off work to have sex. If sex is more important than this job, then she can be fired.

That being said, your boss is a tacky asshole.

i'm not sure if they can fire you or not! but it's a bunch of sh** if they do! i'd take off and tell them to kiss it! and tell your husband he's in our prayers and thank you for his effort!

I don't think there are any laws stopping them. But, it's pretty crappy, and I wouldn't let them get the last word.
