Any online purchase with a credit card is actually a legally binding contract. In that case, most services ask for the card account number along with the personal number on the back of the card. The three digit number which only someone in possession of the card should know acts as an electronic signature. Other ways are to provide a check box that is defaulted to unchecked with the wording to the effect that you agree to placing your electronic signature to a form, application, contract, etc.

Yes you can. The definition of an electronic signature is somewhat vague. It basically includes anything intended to be a signature. In most cases, there is a check-box that says "by checking this box, I agree too ...."
