In my last job, my boss was always taking me to the basement and cussing me, putting me down, and accused me of mistakes that I was not making to cover up for it. I have documentation of the derogatory statements that she made with the dates and everything. Do I have a case here? Should I call a lawyer? Does anyone know how I can find out? Please Help!!!

in a civil suit, you need to have suffered an "injury" as well as have enough evidence.

you will only have a case if:

1. you have told your boss to stop or filed a complaint with human resources

2. you lost/quit your job because of the hostile environment continued

3. you have witnesses that will testify on your behalf


most likely, you can bring a lawsuit against your former employer as well as the former boss. most likely, the company will want to settle. i guess it depends on what you want out of this.

Well first of all you have to establish a time limit. If this occured more than 180 days ago then you have no case. If it has been less then 180 days then maybe. A) Did the comments have anything to do with your sex, age, race, religion, or sex orientation? Or did they have to do with work related things? B) Do you have proof? Ex. Another honest person who can verify, or tape recording of this person harrassing you? Generally these cases are very hard to prove. If you have been sexually harrassed you can file a law suit, but it will be very hard to get anywhere. Best thing to do is talk to this person's supervisor, (if there is one) and tell them the whole story. Or talk to the companies HR department. Chances are if they are a responisble company they wont want this type of scum working for them any longer. Only other thing I can say is beware of horrible people out in the work place. Im sorry this happened to you. ): You can speak to a lawyer for a free consiltation and they will be able to tell you if you have a case. Try a lawyer that specializes in Labor Law suits---- Hope that helps you, Good Luck!

You only have a case if the statements she made are sexist or racist. If she is cussing and belittling you, there is nothing you can do. There are no laws to prevent employers from being a**holes. Since you left and you didn't mention any contracts you had to sign, then I assume it was "at will" employment, further giving you less of a case to sue.

Yes, you have case.

No, you should not pursue it.

The only thing you can control is the future. Unless you want a recommendation from her, there is no reason for you to be involved.

If you sue her for enough, you just might ruin her life or her family. Who knows what her situation is?

One suggestion I have is to write a nice long letter to this wench and throw it away.

I did the same when the doctors screwed up on me!

If you have concrete evidence AND never plan on working again (because even though you were the recipient, you are going to get a reputation as a whistle blower), then go for it!!!
